Terms of Service

These Terms of Service ("Terms") govern your use of the Yosh Call mobile application and website (the "Service") operated by Yosh Call ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Yosh Call. By creating an account, you represent and warrant that:

• You are 18 years of age or older
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under any applicable law
• You have not previously been suspended or removed from the Service

We reserve the right to immediately terminate accounts found to belong to minors without notice.

2. Account Registration

• You must provide accurate, current, and complete information when registering.
• You are solely responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately at yoshcallapp@gmail.com of any unauthorized use of your account.
• One person may not maintain more than one active account. Duplicate accounts will be terminated.
• You may not transfer or sell your account to another person.

3. Virtual Currency — Coins & Diamonds

Coins are virtual in-app currency purchased by users to pay for call time and send gifts to creators. Coins have no cash value and cannot be exchanged for real money.

Diamonds are virtual rewards earned by creators for completed calls and gifts received. Diamonds may be converted to real currency via withdrawal requests, subject to the following conditions:

• All coin purchases are final and non-refundable, except where required by applicable law.
• Coins purchased through Google Play are subject to Google Play's refund policy.
• Unused coins do not expire but may be forfeited upon account termination for cause.
• Diamond payouts are subject to identity verification and may take up to 7 business days to process.
• We reserve the right to adjust conversion rates and payout thresholds with 7 days' notice.
• We reserve the right to withhold payouts pending investigation of suspected fraud or policy violations.
• Fraudulent activity — including artificially inflating call duration, using bots, or coordinated abuse — will result in immediate account termination and forfeiture of all balances.

4. In-App Purchases

Coin packages are available for purchase through Google Play Billing. By making a purchase, you agree to Google Play's Terms of Service in addition to these Terms. We do not process or store payment card information directly. All billing is handled by Google Play.

5. Acceptable Use

You agree not to use the Service to:

• Share, solicit, or distribute sexually explicit, abusive, hateful, defamatory, or illegal content
• Harass, threaten, bully, stalk, or intimidate other users
• Impersonate any person, entity, or Yosh Call staff
• Engage in fraud, scams, phishing, or any deceptive practice
• Solicit personal information from minors
• Attempt to reverse-engineer, decompile, hack, or disrupt the Service
• Use bots, scripts, macros, or automated tools to interact with the platform
• Scrape, crawl, or extract data from the Service without our permission
• Upload malware, viruses, or malicious code
• Violate any applicable local, national, or international law or regulation

We reserve the right to remove any content and take action against any account that violates these rules, at our sole discretion.

6. Creator Guidelines

Creators who accept calls on Yosh Call additionally agree to:

• Maintain a respectful and professional demeanour during all calls
• Not request, encourage, or accept off-platform payments from users
• Not engage in or facilitate any illegal activity during calls
• Keep profile information accurate, honest, and not misleading
• Not share personal contact information (phone numbers, social media) with users during calls
• Not use the platform for escort services, adult content, or any form of exploitation

Violation of creator guidelines may result in immediate suspension, permanent account termination, and forfeiture of all pending earnings without compensation.

7. Content & Intellectual Property

All content on the Service — including the app, website, logo, brand, design, and text — is owned by or licensed to Yosh Call and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

You retain ownership of content you create and share on the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content solely for the purpose of operating and promoting the Service. This licence ends when you delete your content or account.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

9. Termination & Suspension

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for:

• Violation of these Terms or our policies
• Conduct that we determine, in our sole discretion, is harmful to users, third parties, or the Service
• Extended inactivity
• Legal or regulatory requirements

Upon termination, your right to use the Service ceases immediately. You may delete your own account at any time from the Profile settings within the app. We will process your deletion request within 30 days in accordance with our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Use of the Service is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Yosh Call and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from:

• Your use of or inability to use the Service
• Any unauthorized access to or alteration of your data
• Conduct of any third party on the Service
• Any other matter related to the Service

Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Yosh Call and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Third-Party Services

The Service integrates third-party services including Agora (video/audio), Supabase (database), Firebase (notifications and crash reporting), and Google Play Billing (payments). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts of India.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via in-app notification or email at least 7 days before the changes take effect. The updated date at the top of this page reflects the most recent revision. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
